Legislation has either been passed earlier this week or is about to be passed (I’m not sure which) that will have a substantial impact on some of the people who hope to apply to migrate to Australia but who have not yet lodged an application for a GSM visa. GSM = General Skilled Migration = no employer sponsorship. GSM visas can be unsponsored, State sponsored or family sponsored but they are not employer sponsored.

A well-known migration agent gave me his initial reaction to the document above in an e-mail yesterday evening. I quote verbatim:

I was just reading changes coming in on 01 January 2010 require 175/176 applicants (in to-be- gazetted trade occupations) will require 12 months experience in that nominated trade occupation and not “in any skilled occupation.”So those tradies who’s recent experience does not exactly match their nominated occupation, had better try and lodge prior to 01 January 2010.

It could affect recognised tradespersons who are working as supervisors unless they can convince DIAC they are working hands-on in the nominated trade for at least 20 hours per week

It will affect the tradesman who has become a production manager or any other related or unrelated occupation

Bigger things happening on-shore with 885/886 applicants requiring to get suitable skills assessment before applying for the visa AND, for gazetted tradies, a requirement to get a skills assessment dated 01 January 2010 or later.

I wondered where my informant obtained his information till I happened to look at ComLaw for a completely unrelated purpose just now. As far as I can see, there is nothing on the DIAC website about these latest changes from 1st Jan 2010 as yet? I can’t find anything specific, anyway.

I think we will see more about all this soon – probably next week sometime, I suspect.

WESTERN AUSTRALIA — The first gold has been poured and the initial copper concentrate shipment made at the Boddington mine belonging to Newmont Mining of Denver. At full production, this will be Australia’s largest gold mine.

The Boddington mine is a large open pit 130 km southeast of Perth within the Saddleback Greenstone Belt. Newmont believes Boddington has significant exploration potential, with gold reserves increasing from 16.6 million oz in 2007 to 20.1 million oz in 2008 and an expected mine life in excess of 24 years.

A new report has found Australia’s migration program is more effectively meeting the needs of employers with a 60 per cent increase in the number of employer-sponsored skilled migrants to Australia in 2008-09 compared with the previous year.

The Report on Migration Program 2008-09 shows that the Rudd Government’s targeted approach to overseas workers is helping to fill critical skills gaps in the healthcare, engineering, financial services and IT sectors.

The Minister for Immigration and Citizenship, Senator Chris Evans, said that changes introduced in January including the Critical Skills List (CSL) of high value occupations and prioritising employer-sponsored or state/territory-sponsored skilled migration visa grants were having a significant impact.

Overseas workers who were sponsored by employers comprised 33 per cent of the 2008-09 skill stream compared to 22 per cent in 2007-08 and 17 per cent in 2006-07.
“A properly targeted migration program will ensure we have the right sized and appropriately skilled labour force to meet Australia’s needs now and into the future as our economy recovers and grows.”

The Government cut the 2008-09 permanent skilled migration intake in March 2009 by 14 per cent from 133 500 to 115 000 and reduced planning levels for the permanent skilled migrant intake in the overall 2009-10 migration program to 108 100 places.

“This is in direct response to the economic slowdown and represents an overall drop of almost 20 per cent on previous planning levels,” Senator Evans said.

“The migration intake in the coming year reflects the economic conditions while ensuring employers can gain access to skilled professionals in industries still experiencing skills shortages such as healthcare and engineering. “The reduction is being achieved through a cutback in places in independent skilled migration rather than in the high-demand employer-sponsored category or in areas in which Australia has critical skills shortages.”

Across all permanent skilled visa categories, the top three occupations for successful applicants were accountancy (6238), computing professionals (3879) and registered nurses (3355) while the top three countries of citizenship under the skill stream were the United Kingdom (23 178), India (20 105) and China (13 927).

“Australia’s migration program is better targeting the needs of Australian employers who are still experiencing skill shortages,” Senator Evans said.

The Rudd Government’s partnership with business and community leaders to Keep Australia Working has secured more than 1000 jobs in its first week, Minister for Employment Participation, Senator Mark Arbib, announced today.

Senator Arbib today joined Local Jobs Champions Bill Kelty and Lindsay Fox at the third Keep Australia Working Forum at Casula, where he announced 240 jobs in Canterbury Bankstown and South Western Sydney Employment Priority Area.

The Australian Government is providing $3.7 million from the $650 million Jobs Fund for three Western Sydney Projects.

The 240 jobs in Western Sydney bring to more than 500 the positions funded through the Jobs Fund and come on top of the 250 jobs in South Eastern Melbourne and 23 jobs in Northern Tasmania announced at jobs forums earlier this week.

The private sector is also playing a significant role in boosting employment with Lindsay Fox announcing this week he would employ an extra 450 staff over the next two years at Linfox and Woolworths announcing 60 jobs for its new logistics centre in Launceston.

“The Rudd Government is doing everything possible to keep Australians working,” Senator Arbib said. 

“This week by working together – the Government and industry – we’ve managed to create or protect more than 1000 jobs.

“Not every week will be as successful as this week in keeping people in work. There will be ups and downs, because the global recession is far from over.

“But this week has shown what can be achieved by working together.”

Parliamentary Secretary for Employment Jason Clare said community leaders, business representatives and job service providers would today join Government to develop a regional employment strategy for Canterbury Bankstown and South Western Sydney.

“The Keep Australia Working forums allow the community to maximise the benefits of the Government’s Economic Stimulus Plan and Jobs Fund and develop localised responses to the impact of the global recession.

“We want to find job opportunities for local businesses and workers, particularly in areas like Western Sydney where unemployment is a growing problem.”

Mr Clare said Local Jobs Champions, Lindsay Fox and Bill Kelty, would bring their considerable experience and wisdom to the table.

“The Local Jobs Champions will help forum participants identify local skill and labour needs and develop directions for the future,” Mr Clare said.

“It’s great to have Lindsay Fox and Bill Kelty on board. Few people understand the Australian economy better than these blokes, they’ve been through it before. They’re travelling with us around the country helping areas hit hardest by the global recession.”

Today’s forum is the third in a series being rolled out in employment priority areas across Australia as recommended in the Keep Australia Working interim report presented last week to Deputy Prime Minister Gillard by Senator Arbib and Mr Clare.

There are now 20 employment priority areas around the country:

  • Illawarra (New South Wales)
  • Richmond Tweed and Clarence Valley (New South Wales)
  • Mid North Coast (New South Wales)

Last night’s tsunami warning for south-eastern Australia, may have come to nothing, but it did demonstrate the worth of the motsunaminitoring system, says one expert.

The warning was announced soon after an earthquake, measuring 7.8 on the Richter scale, occurred off the south coast of New Zealand’s South Island.

Chief Meteorologist Dr Chris Ryan, of the Joint Australian Tsunami Warning Centre, says the epicentre was located in the closest earthquake source zone to Australia, a region known as the Puysegur seduction zone.

He says, despite being close to Australia, the region is far enough away that a tsunami would take more two hours to reach the coast.

Ryan says the tsunami that followed only warranted a ‘marine threat’ warning with waves rising 30 centimetres at Port Kembla, near Wollongong and no significant damage has been reported.                                                                                                                                                                                                                                                

Seismologist David Jepsen, of Geoscience Australia, says it took two hours for waves from New Zealand to get to Tasmania.

He says the Puysegur seduction zone is a region where Australia’s tectonic plate pushes underneath the Pacific plate.

Although the Australian tsunami warning system is one of the best in the world, the system is still pretty new.

DIAC have just announced that the anyone obtaining their Contributory Parent Visa after 1 July and then planning to sponsor an existing partner will be faced with a potential 5 year wait. What this means, as an initial response, is that people going down that route who have not included an existing spouse in the application should be doing so immediately.

This is the text of the announcement:

Amendments to the Migration Regulations 1994 in relation to Contributory Parent visas and split applications

1 July 2009 Legislation Change

Client summary

From 1 July 2009, the Migration Regulations 1994 (the ‘Regulations’) are amended to prevent persons who are granted a permanent Contributory Parent category visa (Subclasses 143 and 864) from sponsoring their partner or fiancé for a Partner or Prospective Marriage visa for five years from the day of their visa grant, if they:

* were granted their permanent Contributory Parent category visa on or after 1 July 2009; and
* were in a spouse or de facto partner or fiancé relationship on or before the date their permanent Contributory Parent category visa was granted and now wish to sponsor that partner or fiancé.

This limitation may not apply in compelling circumstances which are not financially related.

Additional information:
There have been a number of instances in which couples seeking to migrate under the Contributory Parent category visa provisions have resorted to the split application strategy, whereby:

* only one member of a parent couple applies for and is granted a permanent Contributory Parent category visa; and
* once eligible (usually after two years of being lawfully resident in Australia), this parent subsequently sponsors their spouse (the other parent) under the partner visa category which has a much smaller Visa Application Charge (VAC).

Up until 1 July 2009, this strategy is not prohibited by migration legislation and it is being used in order to reduce the costs associated with migration under Contributory Parent category visa. However, it clearly undermines the Government’s policy intent of ensuring that those parents who migrate under the Contributory Parent visa category make a contribution by means of the VAC to partially offset the significant costs of parent migration to the broader community. Contributory Parent migrants are also subject to the provision of a ten year Assurance of Support (AoS) and payment of a bond.

Furthermore, those who lodge a split application benefit by by-passing the ten year waiting period for parent visa holders to access Government benefits and assistance, whilst spouse visa holders are able to access such benefits within two years of visa grant.

Amendments are being made to information products affected by this legislative change.
