Regulation of the Migration Advice Profession in Australia

Migration agents operating in Australia are required by law to be registered with the Office of the Migration Agents Registration Authority (Office of the MARA).

Prior to 1 July 2009, the MIA acted as the MARA under a Deed of Agreement between the MIA and the department. The 2007-08 Review of Statutory Self-Regulation of the Migration Advice Profession, which was undertaken to assess the effectiveness of the regulatory scheme, recommended that the government consider establishing a regulatory body separate from the MIA.

In response to the review recommendation, the Minister announced the establishment of the Office of the MARA as a discrete office attached to the department and headed by a specifically designated senior officer solely responsible for Office of the MARA activities. The new body is located in Sydney and assumed functions from the MIA from 1 July 2009.

The Office of the MARA is supported by a representative advisory board, which includes a nominee from the MIA, a nominee from the Law Council of Australia, a consumer advocate and a community representative.

The Office of the MARA undertakes a range of functions including:

• processing registration and re-registration applications
• administering the profession’s entrance exam and continuing professional development program
• monitoring the conduct of registered migration agents
• investigating complaints about registered migration agents
• taking appropriate disciplinary action against registered migration agents who breach the migration agents Code of Conduct or otherwise behave in an unprofessional or unethical way.

3 Malaysians nabbed in Perth for A$90,000 fake credit card purchases

THREE Malaysian tourists have been charged for allegedly purchasing more than $90,000 (about RM255,000) worth of jewellery and electrical goods with fake credit cards across Perth.

The two women, aged 21 and 26, and a 31-year-old man, had apparently travelled from the eastern states of Australia to Perth earlier this month and made the  purchases at various shopping centre stores using altered credit cards and false identification. 

Australian news agencies reported that police major fraud squad detectives apprehended the trio following a probe into the use of the counterfeit cards after shop owners alerted them. They are due to appear in the Perth Magistrate’s Court today.

Detective first class constable Rulan Carr from the Police Fraud Squad told ABC News that the suspects  were  traced to the Perth Airport where they were about to board a plane on Wednesday.

The 21-year-old woman was first to be arrested and was in possession of a suitcase allegedly containing a large quantity of jewellery and laptop computers, estimated worth more than $90,000.

The two others were found by police, also at the airport, and taken into custody on suspicion of being involved in the scam.

Debit cards and other documentary evidence were also discovered.

“The items were seized and the persons were charged with various fraud offences,” said Carr. “Investigations are still continuing into those items.”

Further charges are expected to be laid against the three.

Australia doing well on jobs – Rudd

AUSTRALIA is still doing better than other major economies despite a jump in jobless figures, Prime Minister Kevin Rudd says. 

The unemployment rate has risen to 5.7 per cent, after the total number of people in work fell by 1700, official May jobs data showed today.

 “Today we have seen an increase in unemployment to 5.7 per cent, returning to where it was in March this year, although employment remained fairly steady falling by 1700,” he told delegates at an Australian Industry Group lunch in Sydney.

He said the unemployment figures were indicative of how the financial crisis was affecting Australia.

“The global recession is continuing to have a direct impact on the Australian economy and Australian jobs,” Mr Rudd said.

“No one likes to see unemployment rise because of the global recession … (but) Australia’s unemployment rate remains lower than all other major advanced economies except Japan.”

He said the figures would have been far worse had it not been for the government’s stimulus packages.

“`Without our nation building plans, over 200,000 more Australians would be out of work,” he said.
